Plantonio.com Affiliate Program Terms of Service Agreement
This Terms of Service Agreement ("Agreement") is a legal agreement between you ("Partner/Affiliate" or "you") and Plantonio.com ("Company" or "we") governing your participation in the Plantonio.com Affiliate Program ("Affiliate Program"). By accessing or using the Affiliate Program, you agree to be bound by the terms and conditions of this Agreement.
1. Acceptance of Terms
By joining the Affiliate Program, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree with any part of this Agreement, you must not participate in the Affiliate Program.
2. Participation in the Affiliate Program
a. Eligibility: You must be at least 18 years old or have the legal capacity to enter into a binding agreement in your jurisdiction to participate in the Affiliate Program.
b. Enrollment: Upon approval, you will be granted access to the Affiliate Program and provided with unique tracking links and promotional materials.
c. Prohibited activities: You agree not to engage in any activity that may harm the reputation of Plantonio.com or violate any applicable laws or regulations.
3. Commission and Attribution
a. Commission Structure: As an affiliate partner, you are eligible to earn a 25% commission on all qualified referrals.
b. Lifetime Attribution: Once you refer a customer, they become attributed to your account for life, ensuring you receive commissions on all future purchases made by that customer.
4. Intellectual Property
a. Ownership: All promotional materials, including but not limited to banners, logos, and text links, provided by Plantonio.com are owned by the Company and may only be used for the purpose of promoting the Affiliate Program.
b. Restrictions: You agree not to modify, reproduce, distribute, or display any promotional materials without prior written consent from Plantonio.com.
5. Privacy and Data Protection
a. Data collection: By participating in the Affiliate Program, you consent to the collection and use of your personal information as outlined in our Privacy Policy.
b. Confidentiality: You agree to keep all confidential information obtained through the Affiliate Program confidential and not to disclose it to any third party without prior written consent from Plantonio.com.
6. Termination
a. Termination by Partner: You may terminate your participation in the Affiliate Program at any time by discontinuing the use of your affiliate account.
b. Termination by Company: Plantonio.com reserves the right to suspend or terminate your participation in the Affiliate Program at any time, without prior notice, for any reason.
7. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of NY. Any disputes arising out of or in connection with this Agreement shall be resolved through binding arbitration in accordance with the rules of NY.
8. Miscellaneous
a. Entire Agreement: This Agreement constitutes the entire agreement between you and Plantonio.com regarding your participation in the Affiliate Program.
b. Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
c. Modifications: Plantonio.com reserves the right to modify or update this Agreement at any time. Any changes will be effective upon posting the revised Agreement on the Affiliate Program platform.
By participating in the Affiliate Program, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
